These Terms and Conditions (“Terms”) govern the use of the Layers Pools website (layerspools.com) and any pool construction, renovation, or maintenance services provided by Layers Pools (“we,” “our,” “us”). By contacting us, requesting a quote, or engaging our services, you (“client,” “you”) agree to these Terms.

01 Acceptance of Terms

By using our website, submitting an enquiry, or proceeding with a quotation from Layers Pools, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with any part of these Terms, please discontinue use of our services and inform us directly.

02 Our Services

Layers Pools provides swimming pool design, construction, renovation, resurfacing, filtration/equipment installation, and maintenance (AMC) services. Every project follows our standard 5-stage process: site visit & consultation, design & fixed quote, excavation & structure, tiling & equipment, and final water testing.

03 Quotations & Pricing

Quotations are provided free of cost following an initial site visit and are based on the site conditions, design, and scope discussed at that time. Once a quotation is accepted in writing, the price is fixed and will not change unless the client requests a change in scope, design, or materials after work has begun.

Any change requested by the client after the quotation is accepted may result in a revised quotation, which will be shared and agreed upon before the additional work is carried out.

04 Payment Terms

Payment schedules are agreed upon with each client individually and outlined at the time of quotation, typically structured in stages aligned with project milestones. Full and final payment is due upon completion and handover of the project, unless otherwise agreed in writing.

Delays in scheduled payments may result in a corresponding delay in project timelines.

05 Project Timelines

A projected timeline is shared and agreed upon before work begins. While we commit to the timeline discussed, factors outside our control — including weather conditions, site access issues, delays in client-approved changes, or force majeure events — may affect the schedule. We will communicate any such delays as soon as they arise.

06 Client Responsibilities

To ensure smooth project execution, clients are expected to:

• Provide accurate site access, ownership, and legal permissions required for construction
• Respond to design approvals and material selections in a timely manner
• Ensure timely payments as per the agreed schedule
• Inform us of any underground utilities, structural concerns, or site-specific risks known to them prior to excavation

07 Warranty & After-Sales Support

Our construction work is backed by a structural warranty against manufacturing or workmanship defects, the specific terms and duration of which are confirmed in writing at the time of project handover. This warranty covers structural integrity and does not extend to damage caused by misuse, lack of maintenance, natural wear, or third-party alterations.

After-sales support and Annual Maintenance Contracts (AMC) are available separately and are governed by the terms of the specific AMC agreement signed with the client.

08 Cancellation & Refunds

Clients may cancel a project before work begins, subject to forfeiture of any non-refundable design, planning, or booking amount already paid. Once construction has commenced, cancellation may only be accepted with reimbursement to Layers Pools for work completed, materials procured, and costs incurred up to that point.

Refunds, where applicable, will be processed within a reasonable timeframe following mutual agreement on the final settlement amount.

09 Limitation of Liability

While we take every reasonable measure to ensure quality and safety, Layers Pools shall not be held liable for damages arising from circumstances outside our reasonable control, misuse of the completed pool or equipment, failure to follow maintenance guidelines provided by us, or unauthorized modifications made by the client or a third party after handover.

10 Intellectual Property

All designs, layouts, drawings, and proposals created by Layers Pools remain our intellectual property until the associated project is paid for in full. Content on our website, including text, images, and branding, is owned by Layers Pools and may not be copied or reused without written permission.

11 Website Use

Our website is provided for informational purposes to help you understand our services and get in touch with us. You agree not to misuse the website, attempt unauthorized access to its systems, or use it in any way that could damage, disable, or impair its functioning.

12 Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the jurisdiction of the courts in Gurugram, Haryana.

13 Changes to These Terms
